The garnishment process presents multiple challenges, including processing high document volumes, potential risk for failing to timely seize funds, and complying with various state law requirements. And in May, the Consumer Financial Protection Bureau (CFPB) consent order put a spotlight on account garnishments as a compliance concern. Finding that Bank of America had engaged in unfair and deceptive garnishment practices, the CFPB levied a $10 million fine, ordered at least $592,000 refunded to customers, and imposed enhanced regulatory oversight. An accompanying press release declared that BofA’s garnishment processes had deceived customers and violated federal consumer protection laws.
